Green Card Advice! If you have gone through the process through marriage please help.?

I am a U.S. citizen and my boyfriend is from South Africa. We plan to get engaged this summer and married possibly next year. He has a student visa that expires in May of next year. I know you cant apply for a green card through marriage until you are already married but his student visa will expire before we get married. Has anyone been through this and can give some advice? I want to hear from people who have actually gone through this!

If he’s going to graduate before you get married then what you should do is have a quiet civil wedding at the courthouse BEFORE graduation. File all the immigration paperwork for an adjustment of status.

It is a process. When you have to justify yourself and your relationship to others, it is never completely pleasant, but the government representatives try to make you as comfortable as possible during interviews.

Why would it take over 3 yrs to get a Green Card through marriage?

My friend has been married to this guy for a little over 3 yrs now. Just recently, they hired an immigration attorney to get things going on his Green Card. Why so long? Is that normal?

I guess you would have to ask her why she took 3 years to hire an immigration lawyer.  The only answer to the question would be found in the paperwork.

I want to apply for green card through marriage?

I was getting cash and food stamps for my child who is US citizen.
Now I am engaged with a guy who is US citizen also and we are planning to get married and I am concerned about the fact that I was getting cash and food stamps ONLY for my child in the past. Is that going to affect somehow the process of getting green card for me in the future.

Dan Richardson answers:

This will be evaluated by USCIS as a part of their processing of your application.  Since all the money and food stamps went to a US citizen, you may still be able to adjust status.

I just married my wife last week. We are still waiting for marriage certificate from SF city hall. My wife was an international student. I would like to apply a green card for her. How can i do that? How long shall she get the green card? Where can I find more sources about this?

Make sure you have started getting ALL the papers you will need whilst you are waiting for your marriage certificate.  The process of changing immigration status from student to green card is called adjusting status.  I have many materials on this website about how to adjust status.

what happens after wife applies for green card?

My wife and I are both French and currently live in Sacramento. My wife is being petitioned for a green card through her job. My question is will I automatically get the green card since she’s my wife? How long do we have to wait for the process to be completed?

Nothing will be assigned to you automatically, she has to put your name in her application as her dependent and then INS will process her application with both of your names. It is a process that takes time and money, and it is not automatic.

My wife lost her green card 6 years ago. She needs a temporary card how do we get it?

I am a US born citizen married to my wife who is not a citizen.She lost her green card 6 year ago and has no ID other than a social security card. She will apply for citizenship in a couple of days. Will Immigration give her some kind of temporary card so that she can work?

In order to get citizenship, you must have been a green card holder for either 3 years or five years.  I would suggest first replacing the green card and then applying for citizenship.

My wife had a green card before but turned it in. How does she get another one?

Had a green card for about 6-7 years. Now we’re living in the States and want to apply for another green card. The USCIS website doesn’t offer info specific to this situation. Not that I‘ve been able to find anyway.

You didn’t give enough facts to answer that question, but critical fact number one is whether or not she entered the country legally and how she gave up her green card.  Please refer to adjust status materials on this website for details based on those facts.

Hey all, I just obtained my Green card, and I intend to get married soon :)
My question is what do I have to do to get my wife a green card? I intend to bring her over to the US.
tell me all the details and how long it takes to do it.  Additional details: she’s Egyptian, I‘m Jordanian. she’s 18, and I‘m 22. we’re Muslims,

Dan Richardson answers:

Sorry, bad timing.  You can petition your wife as a green card holder, but this is subject to the preference system, and it may take 4-5 years and she is not allowed to wait in the US.  If you move to where she lives you will not be living in the US and will     lose your green card after a year.  Once you are a citizen, you can petition her for a marriage visa K-3, and the processing is typically about 6 months.

Other possibility is if she has an advanced degree and can get a work visa on her own. Or maybe she could get a student visa – but she would have to be able to pay the tuition fees and be a serious student. She would need to attend classes and maintain acceptable grades. By the time she gets a greencard she could have a degree.
